He translated the Holy Qur’ān in 1880. He was not as prejudiced as other western translator of the Holy Qur’ān had been in their works. Palmer's rendering is also not free from errors. He had been allowed a short period to accomplish this task. He rendered such a serious assignment in haste. His tragic murder did not allow him to revise his translation. He was killed two years after publication of this translation. He has left out some complete verses of the text untranslated. Imam Ibn-e-Habban has also discussed the stories of women along with other science and arts through story-telling Ahadith. The word “قصص” (Stories) is from Arabic language, the singular of which is “قصّہ” (story). The original meaning of the word “قصہ” is any narration or event from near past and the same meaning is used in denomination. Human has natural tendency towards stories and narrations. Hence, both the ends took advantages to understand each other but unfortunately the dark side of this interaction has been visible on many occasions because of certain reasons including the stereotypes associated with Islam. The history of the Crusades might be a relevant example in this context, which allows the observers to better understand the various factors behind the conflict between Islam and the West. Some people in the West, relying upon the prevailing stereotypes, consider Islam as a religion of violence and extremism that intends to forcefully "Islamize" the Western world. On the other hand, there are some circles in the Islamic world that believe in the similar stereotypes associated with the West and its civilization. Likely, there are two specific divisions found in Tafaseer and Hadith books: Makki era and Madni era. Generally it is understood that they are two separate eras, which are completely different from each other. Even this delusion is found about Quranic Verses which are divided as Makki and Madni Verses and Surahs. From this aspect orientalist objected Islam too. But the fact is that the rules of Islam come according to the conditions of whom Islam spoke to or according to the circumstances and situations at the time of Revelation. So there is the consistency in the revelations, whether they are revealed in Makkah or Madina. On the contrary, most of the Ahnaf describe them as five in number: Zina, Sariqa, Qazaf, Shurb-e-Khamr and Suqer and they consider Haraba parallel to Sariqa. According to the Ahnaf, Hadd is imposed on the punishment of those crimes which are related specifically to the rights of Allah, whereas most of the Jurists don’t differentiate among the rights of Allah and the rights of the people in terms of defining the Hadd. According to them, Hadd can also be imposed on Qisas but according to Ahnaf, Hadd cannot be applied on Qisas. The purpose of the imposition of Hadood is to reform the people for the establishment of peace in society avoiding the conflict and violence. The concept of Hadood is found not only in Islam but other religions have also focused on them. The crimes that are directly related to rights of Allah as Zina and drinking alcohol, cannot be exonerated even by the court of law and further, the crimes that are related both to the rights of Allah and rights of the people can be exonerated when it is among the convicted but when reaches to the court of law, cannot be exonerated even by the court of law. It has clearly mentioned in Quran and Hadith that the right of inheritance is preserved for the women as well as for the men. Civil law of Pakistan also provides the women with full security regarding this. Despite this force of Law and Sharia, there are countless cases in courts of Pakistan being heard by Civil, High and Supreme Court which indicate that the exploitation of women right in inheritance is taking place at large scale. It is important to take this sensitive situation into account and spread light on it with the intention to explore the core issue in order to raise the voice about women rights. Courts in Pakistan have paid particular attention toward solving this problem and a number of judgments have come into appearances which are helpful to understanding the reasons and causes of this type of exploitations. It is the purpose and objective of all the Prophets of Allah to establish a system of justice on earth. In the early days of Islam the Prophet (PBUH) himself was the only judge among believers and non-believers. Caliph Umar bin al-Khattab was the first who separated judiciary from the executive and entrusted the Qadhis (judges) with power of deciding suits of purely civil nature. Independence of judiciary can hardly become reality unless competent judges are appointed in the judiciary. The role of a judge is very crucial and critical because he has the power to award proper punishment and also to decide civil cases on merits. To ensure the justice according to the Islam in consonance with the will of Allah, qualified, powerful and fearless persons should be appointed as judges. Because a position of judge is a trust for the benefit of public. The person appointed to it is a trustee and is accountable for the proper performance of the duties attached to such trust. The judge in the Islam enjoys full freedom and work quite independently without being influenced by any political pressure. The legal maxims are based on the fiqh itself. A legal maxim is reflective of a consolidated reading of the fiqh. Islamic Legal Maxims represent an important are of fiqh literature. Islamic legal maxim has similarity to the judicial rules in many aspects, there for I analyses the appointment of judges as a comparative study in light of Islamic legal maxim and Pakistani laws. The Constitution of the Islamic Republic of Pakistan, for instance, provides for the establishment of a judiciary which is independent from the other two branches of government. As per the wording of 1973 Constitution , The Chief Justice and the other judges of each Court are appointed by the President based on their experience and qualifications (article 193 (2))۔ I learnt after the study that a great difference and Contradiction was found between the constitution of Pakistan and Islamic legal maxim in Perspective of the appointment of judges.
2020-07-30T00:00:00+00:00 ##submission.copyrightStatement## مالی معاملات میں اجارہ کاتعارف اور عصرحاضر میں اس میں لگائی جانے والی شروط کے اثرات کا شرعی جائزہ 2020-07-31T18:11:05+00:00 Khalilul Rehman
Leasing is a vital part of economic activities. So, in fact Islam develops a moral sense in an individual and society against crime not through interdiction and sanction but gradually, gently, exactingly, understandingly, and at deep level.
